LIABILITY WAIVER AND RELEASE AGREEMENT

WAIVER AND RELEASE OF LIABILITY
 

I, the undersigned participant (“Participant”), voluntarily elect to participate in guided hunting activities provided by Fossa de Prestito, including its owners, officers, guides, employees, contractors, agents, landowners, and affiliates (collectively, the “Releasees”).

 

1. ASSUMPTION OF RISK
 

I understand and acknowledge that guided hunting is an inherently dangerous activity that involves substantial risks, including but not limited to:
 

• Use and discharge of firearms and ammunition

• Uneven terrain, flooded timber, mud, brush, and agricultural fields

• Slips, falls, cuts, puncture wounds, and wildlife encounters

• Exposure to extreme weather, cold water, hypothermia, and natural hazards

• Use of boats, ATVs, UTVs, blinds, elevated platforms, and hunting dogs

• Accidental injury caused by other participants
   

I knowingly, voluntarily, and fully assume all risks, whether known or unknown, foreseeable or unforeseeable, including the risk of serious bodily injury, permanent disability, or death.

 

2. RELEASE AND WAIVER OF LIABILITY
 

To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue the Releasees from any and all claims, demands, causes of action, damages, losses, or liabilities of any kind, including those arising from the negligence of the Releasees, related to or arising out of my participation in any hunting or related activities.
 

This release applies to personal injury, death, property damage, or any other loss, whether occurring on lodge property, hunting grounds, travel to or from hunting locations, or during any guided activity.

 

3. INDEMNIFICATION AND HOLD HARMLESS
 

I agree to defend, indemnify, and hold harmless the Releasees from any claims, actions, damages, costs, or expenses (including attorney’s fees) arising from:
 

• My participation in hunting activities

• My violation of any law, rule, or instruction

• My actions or omissions that cause harm to myself or others
  
   

4. FIREARMS, SAFETY, AND LEGAL COMPLIANCE
 

I affirm that:
 

• I am legally permitted to possess and use firearms and ammunition

• I will follow all firearm safety rules and guide instructions at all times

• I will comply with all federal, state, and local hunting laws and regulations

• I understand that alcohol, drugs, or unsafe conduct may result in immediate removal without refund
  
   

5. MEDICAL AUTHORIZATION
 

I authorize Fossa de Prestito to obtain emergency medical treatment for me if necessary. I understand and agree that I am financially responsible for all medical care, transportation, and related costs incurred.

 

6. PARTICIPANT CONDUCT
 

I agree to conduct myself in a safe, respectful, and lawful manner. I understand that failure to comply with guide instructions or lodge rules may result in immediate termination of participation without refund.

 

7. PHOTOGRAPHIC & MEDIA RELEASE
 

I grant Fossa de Prestito the unrestricted right to use photographs, video, and audio recordings of me taken during hunting activities for marketing, promotional, and commercial purposes, without compensation.

 

8. SEVERABILITY
 

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

 

9. GOVERNING LAW & VENUE
 

This Agreement shall be governed by and interpreted under the laws of the State in which the hunting activities occur, without regard to conflict‑of‑law principles. Venue for any legal action shall lie exclusively in that state.

 

ACKNOWLEDGMENT OF UNDERSTANDING
 

I HAVE READ THIS AGREEMENT IN ITS ENTIRETY, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY. I UNDERSTAND THAT BY SIGNING THIS DOCUMENT, I AM GIVING UP CERTAIN LEGAL RIGHTS.

I am the parent or legal guardian of the minor named above. I consent to the minor’s participation and agree to all terms of this Agreement on their behalf.
